We thank you for your interest in joining the CMCC Consortium. You will find below a comprehensive guidance of the procedure to join the Consortium: Membership criteria, the admission procedure as well as admission fees.

  • Membership Criteria: Article 6
    It is the responsibility of each applicant to ensure that it meets the membership criteria. The CMCC Consortium is open to any manufacturer or importer of Chromium established inside or outside the European Union, which intends to register Chromium under REACH. The consortium is also open to any formulator of a preparation or producer of an article containing Chromium.
  • Admission Procedure: Article 6, Article 8
    Any applicant meeting the membership criteria may join the consortium by executing the Agreement and paying the fee required.

    The Steering Committee will be responsible for approving new applications to join the Consortium. Any refusal of an application for membership will have to be justified, documented and addressed to the applicant.

    Accordingly, any operator meeting the membership criteria may at any time apply to become a Member of the Consortium. However, admission will be subject to a specific admission procedure and to the proportionate and transparent compensation of the human and financial resources invested by the previous members in the Consortium.

    Please note that operators not willing to join the Consortium may have a right to refer to or a right to use the Registration dossiers or any specific data developed by the Consortium, by paying a financial compensation to be defined by the Consortium.
  • Admission Fees: Article 9 and Article 59
    After 1st April 2009, every new Member shall pay the admission fees pursuant to Article 9 which are composed of:
    • 1) A fixed fee corresponding to an equal share of the Generic Costs for the year of admittance in the Consortium and for each year preceding its admittance in the Consortium and to the costs of drafting the Agreement. The Generic costs cover all the expenses incurred by the Consortium Members for the development and management of the Consortium.
    • 2) A variable fee corresponding to a proportionate and transparent share of Data Costs which covers both:
      • Historical Data Costs corresponding to existing data already developed by the Members or third parties prior to the creation of the Consortium, based on the cost-sharing formula set out in Article 63. Please note that, at this point, the exact amount of the Historical Data Costs have not been determined by the Consortium.
      • New Data Costs corresponding to the new data developed or acquired by the Members for the purpose of the Consortium calculated in accordance with the cost sharing formula set out in Article 63. Please note that it is not possible to determine at this point which new studies will have to be conducted and consequently we are not in a position to calculate the amount that new Members will have to pay for New Data Costs.
    • 3) A sweat equity compensation corresponding to the contribution already made to the Consortium by existing Members.
    • 4) A financial equity corresponding to the money made available to the Consortium by existing Members.

Based on the above, we are currently not in a position to provide the exact amount of the fees required for joining the Consortium.
